Terms of Service and Use Agreement for Mansoj Dal Store


Introduction:

Mansoj Dal e-store welcomes you and informs you that you will find below the terms and conditions governing your use of this store and all the legal consequences resulting from your use of the store's services via this electronic platform. Any person's use of the store — whether as a consumer of a service, a product, or otherwise — constitutes their full approval, acceptance, and legal capacity, under Sharia and statutory laws, to all the articles and provisions of this agreement, and confirms your commitment to its regulations. This agreement applies to all types of transactions between the consumer and the store. It is considered effective and enforceable as soon as you approve it and begin registering on the store, pursuant to Article 10 of the Saudi Electronic Transactions Law.



Article 1 - Introduction and Definitions:

The above preamble is considered an integral part of this agreement. Below are the meanings and definitions of the main terms used in this agreement:

1. ( The Store ): This definition includes all forms of the Mansoj Dal platform on the World Wide Web, whether it is an electronic application, a website, or a digital storefront.

2. ( The Consumer ): Any individual who engages in e-commerce with the desire to obtain the products or services provided by the store through its electronic platform.

3. ( The Agreement ): Refers to the terms and conditions of this agreement, which govern and regulate the relationship between the parties involved.



Article 2 - Consumer's Legal Capacity:

1. The consumer acknowledges that they possess the valid legal capacity under Sharia and statutory laws to transact with the store, or that their age is not less than eighteen (18) years.

2. The consumer agrees that in the event of violating this article, they shall bear the consequences of such violation before third parties.



Article 3 - Nature of Obligation:

1. The obligation of Mansoj Dal towards consumers is to provide the luxury abayas and products displayed on the platform.

2. The store may provide other services, such as after-sales services or other related services, depending on the nature and type of product requested by the consumer.



Article 4 - Regulations of Use:

1. The consumer commits to using the electronic platform of the store in accordance with public morals and the regulations in force in the Kingdom of Saudi Arabia.

2. The consumer commits, when purchasing a product from this store, not to use this product in any way that violates public morals and the regulations in force in the Kingdom of Saudi Arabia.



Article 5 - Accounts and Registration Obligations:

Upon applying to join this store as a registered member, you are obligated to disclose specific information and choose a confidential username and password to use when accessing the store's services. By doing so, you agree to:

1. Be responsible for maintaining the confidentiality of your account information and password, and immediately notify the store of any unauthorized use of your account or any other breach of your confidential information.

2. The store shall not be liable under any circumstances for any direct or indirect, moral or material loss that may befall you as a result of disclosing your username or password.

3. You commit to using your account or membership at the store personally, as you are fully responsible for it. If someone else uses it, this constitutes a presumption that you have authorized them to use the store in your name and on your behalf.

4. You commit to using the store with absolute seriousness and credibility.

5. You commit to disclosing true, accurate, updated, complete, and legal information about yourself as required during registration, and you commit to updating your data if it changes in reality.

6. Our store commits to handling your personal information and contact addresses with absolute confidentiality.

7. If it is revealed that you have disclosed untrue, inaccurate, incomplete, or non-current information, or information that violates the terms of this agreement, the store has the right to suspend, freeze, or cancel your membership and account on the platform, without prejudice to the store's other rights and legitimate means to recover its rights and protect other consumers.



Article 6 - Electronic Communications and Official Means of Communication:

1. The parties to this agreement agree that official communication shall be conducted via the e-mail or official communication channels registered on the platform.

2. The consumer agrees that all agreements, advertisements, data, and other communications provided electronically serve as their written counterparts, constituting a legally binding argument in meeting statutory and Sharia requirements.

3. The consumer agrees to the possibility of communication and notification regarding any provisions concerning this agreement or transactions through general broadcasts sent by the store management to all consumers or specific users.



Article 7 - Amendments to the Terms of Use and Fees:

1. In the event that any article or clause contained in this agreement is canceled, or if any article or clause is no longer effective, such an occurrence does not invalidate the validity of the remaining articles, clauses, and provisions, which shall remain in effect until further notice from the store management.

2. This agreement — which may be amended from time to time as circumstances require — constitutes the operational mechanism, understanding, and agreement between the consumer and the store.

3. The store may impose fees on some consumers, depending on the offers, products requested, or fees and taxes (such as Value Added Tax - VAT) imposed by the state on the nature of the product.

4. The store reserves the right to add, increase, reduce, or discount any fees or expenses under the articles, clauses, and provisions of the terms of use for any consumer, regardless of the reason for their registration.



Article 8 - Payment and Settlement Services:

1. Through its partners, the store provides an electronic payment and settlement system entirely online through the payment options available on the store (such as Mada, Visa, Apple Pay) or any payment method provided by the store from time to time.

2. The store commits to determining the price of the product displayed in its storefront in accordance with the commercial value approved for the pieces.

3. The store commits to providing electronic invoices for all amounts arising from purchases in the store and commits to giving the consumer an invoice for their purchased product.

4. The store commits to providing the approved accounting specifications on its e-store in application of the provisions of this agreement.



Article 9 - Intellectual Property:

1. The intellectual property rights of Mansoj Dal are entirely owned by the store, whether owned before or after the establishment of this electronic platform.

2. The consumer must respect the intellectual property rights of the store, which include the name of the store itself (Mansoj Dal), words, logos, symbols, and innovative abaya designs displayed on the store. Every right attached to the store's name is an intellectual property right completely owned by the store.



Article 10 - Store's Liability:

1. The store commits to conducting its commercial operations through this electronic platform in a regular manner and in accordance with the regulations in force in the Kingdom of Saudi Arabia, and pursuant to the provisions of this agreement.

2. The store does not bear any claims arising from errors or negligence caused indirectly or accidentally by the consumer or by a third party such as shipping companies, provided that the store has handed over the shipment in its intact condition.

3. Mansoj Dal, its employees, owners, and representatives commit to ensuring that the product is intact, lawful, and authorized in accordance with the laws and regulations of the Kingdom of Saudi Arabia.



Article 11 - Restriction of Access or Membership:

The store may suspend or cancel the consumer's membership or restrict the consumer's access to the platform's services at any time, without notice, and for any reason deemed by the store to be in violation of the clauses of this agreement.



Article 12 - Applicable Law:

This terms of use agreement is governed and drafted in accordance with the laws, regulations, and legislation in force and applicable in the Kingdom of Saudi Arabia, and is completely and entirely subject to the regulations in force with the competent authorities in the Kingdom.



Article 13 - General Provisions:

1. The Arabic language is the applicable language when interpreting the provisions of this agreement, or when translating it into another language.

2. All prices displayed on the store's products are subject to modification from time to time.

3. Promotional or marketing offers that the store may place are temporary offers, and the store reserves the right to modify or stop these promotional or marketing offers at any time.

4. The parties to this agreement commit to transacting with each other in a manner that does not violate Sharia rules, laws, and regulations related to e-commerce.

5. This terms of use agreement can only be canceled by a decision issued by the management of Mansoj Dal.
